Terms of Sale
These terms govern orders placed on mysomnevia.com with SOMNEVIA, operated by A. Mercer, a French micro-enterprise based in Paris, France.

1. Products
The essential characteristics, price and instructions for use of each product are shown on its product page. Photographs are illustrative.
The SOMNEVIA Cloud is an ergonomic memory foam pillow intended for adult use as ordinary bedding. It is a comfort product, not a medical device: it does not diagnose, treat or prevent any condition. If you suffer from persistent neck or back pain, or from a sleep disorder, consult a healthcare professional.
2. Prices
Prices are displayed in the currency of your market, inclusive of VAT where applicable. Delivery charges, where any apply, are shown before you confirm your order.
SOMNEVIA may change its prices at any time. The price charged is the one displayed at the moment your order is placed.
3. Placing an order
Before paying, please check the items selected, your delivery address and your contact details.
Your order is confirmed once payment has been accepted and you have received our confirmation email.
SOMNEVIA may cancel an order in the event of a declined payment, suspected fraud, unavailability of the product, or a manifest pricing error. Any sum already taken is refunded in full.
4. Payment
Payment is due when the order is placed, using one of the methods offered at checkout.
Payments are handled by secure providers. SOMNEVIA does not store full payment card details.
5. Delivery
Destinations served, delivery charges and estimated times are shown before payment and set out in full in our Shipping Policy.
You must provide a complete and accurate address. SOMNEVIA is not liable for delay or failed delivery resulting from an incorrect or incomplete address.
6. Right of cancellation
You have 14 days from receipt of your order to cancel it, without giving a reason, by contacting support@mysomnevia.com.
For reasons of hygiene, a pillow that has been slept on, unsealed or washed cannot be returned where you have simply changed your mind. This restriction does not apply to a faulty, damaged or incorrect product.

7. Statutory guarantees
You benefit from the statutory guarantee of conformity and, under French law, from the guarantee against hidden defects. These guarantees apply independently of any commercial guarantee offered by SOMNEVIA and are not limited by these terms.
8. Liability
SOMNEVIA is not liable for damage resulting from use contrary to the instructions, warnings or contraindications supplied with the product.
Nothing in these terms limits the mandatory rights you hold as a consumer.
9. Personal data
Personal data needed to process orders is used in accordance with our Privacy Policy.
10. Complaints and mediation
For any complaint, write to support@mysomnevia.com.
If a written complaint remains unresolved, a consumer may refer the matter free of charge to the competent consumer mediator, or use the European Commission's online dispute resolution platform.
11. Governing law
These terms are governed by French law, without depriving the consumer of the mandatory protections applicable in their country of residence.
